Introduction

Welcome to MeloTune™. These Terms of Service ("Terms") govern your access to and use of the MeloTune™ mobile application and services ("Service") operated by SYM.BOT Ltd. By using MeloTune™, you agree to be bound by these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.

1. Acceptance of Terms

By downloading or using MeloTune™, you represent that:

• You are at least 13 years of age
• You have the legal capacity to enter into this agreement
• You will comply with these Terms and all applicable laws

2. Service Description

2.1 MeloTune™ Services

MeloTune™ provides:

• Voice and text mood input for music discovery
• Emotion and Energy dial controls
• Stations to save and recall mood presets
• Integration with Apple Music and Spotify
• Multi-device playback support via Spotify Connect
• Favorites and personalized playlists

2.2 Medical Disclaimer

MELOTUNE™ IS NOT A MEDICAL DEVICE OR MENTAL HEALTH TREATMENT. MeloTune™ is designed for music discovery and personal listening experiences; it is not medical advice. It is not a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

3. User Responsibilities

You agree to:

• Use the Service only for lawful purposes
• Not attempt to reverse engineer or hack the Service
• Not misuse the Service, interfere with it, or attempt unauthorized access
• Comply with all applicable laws and regulations
• Respect intellectual property rights

4. Music Service Requirements

4.1 Third-Party Subscriptions

MeloTune™ does not provide music streaming services. To use MeloTune's playback features, you must have an active subscription to:

• Apple Music, or
• Spotify Premium

If you do not have Spotify Premium, Spotify playback features within MeloTune will be unavailable.

4.2 Music Streaming Terms

Your use of music services is governed by the respective provider's terms:

• Apple Music: Apple's Terms of Service
• Spotify: Spotify's Terms of Use

MeloTune™ is not responsible for changes to music service availability, pricing, or features. MeloTune is independent software and is not affiliated with, endorsed by, or sponsored by Apple Inc. or Spotify AB. Apple and Spotify are responsible for their own services and policies. We are not responsible for third-party websites or services linked from the Service.

4.3 Spotify Connect

When using Spotify, you may select playback devices through Spotify Connect. Spotify Connect features require an active Spotify Premium subscription. Spotify Connect availability and device compatibility are controlled by Spotify.

4.4 OpenAI API (Voice/Text Mood Input)

Voice and text mood input features require your own OpenAI API key:

• You must obtain and provide your own OpenAI API key
• You are responsible for all OpenAI API usage costs
• Your use of OpenAI is governed by OpenAI's Terms of Use
• SYM.BOT Ltd is not responsible for OpenAI service availability, pricing, or changes

MeloTune is not affiliated with, endorsed by, or sponsored by OpenAI.

5. Intellectual Property

5.1 MeloTune™ Ownership

All rights, title, and interest in MeloTune™, including:

• App design, UI/UX, and functionality
• Algorithms and recommendation engine
• Trademarks, logos, and branding
• Documentation and user guides

are owned by SYM.BOT Ltd and protected by copyright, trademark, and other intellectual property laws.

5.2 User Data

You own your content and inputs. All data is stored locally on your device. SYM.BOT Ltd does not claim ownership over your locally stored data.

5.3 Music Rights

All music content is owned by respective artists, labels, and publishers. MeloTune™ does not claim ownership of any music accessed through third-party services.

6. Subscriptions and Payments

6.1 Subscription

MeloTune™ may offer a free trial and a recurring subscription. Pricing varies by region and will be shown in the App Store at the time of purchase.

6.2 Billing and Renewal

Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Billing is handled by Apple via your Apple ID. You can manage or cancel in iOS Settings > Apple ID > Subscriptions.

6.3 Refunds and Cancellation

• Refunds are governed by Apple's App Store refund policy
• Cancel anytime through iPhone Settings > [Your Name] > Subscriptions
• Cancellation takes effect at the end of your current billing period
• You retain full access until the end of your paid period
• SYM.BOT Ltd does not have access to your payment information

6.4 Price Changes

We may change subscription pricing from time to time. Any change will be presented through the App Store, and where required, you will be notified and asked to consent before a price increase takes effect.

7. Disclaimers and Limitations of Liability

7.1 Service Availability

MeloTune™ is provided "AS IS" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free operation
• Specific music outcomes
• Compatibility with all devices
• Availability of third-party music services

7.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MELOTUNE™ AND SYM.BOT Ltd SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of data, profits, or business opportunities
• Personal injury or emotional distress
• Actions or omissions of third-party services

To the extent permitted by law, our total liability shall not exceed the amount you paid for the Service in the past 12 months. Nothing in these Terms limits liability that cannot be limited under applicable law.

8. Termination

8.1 By You

You may stop using MeloTune™ at any time by deleting the app. Deleting the app removes locally stored app data from that device (subject to iOS backup/restore behavior).

8.2 By Us

We may discontinue the Service if you:

• Violate these Terms
• Attempt to hack or exploit the Service
• Use the Service for illegal purposes

8.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Deleting the app removes locally stored app data from that device (subject to iOS backup/restore behavior).

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms on our website and/or in the app, and updating the "Last updated" date. Your continued use after changes constitutes acceptance of the updated Terms.

10. Governing Law and Disputes

10.1 Governing Law

These Terms are governed by the laws of Scotland.

10.2 Dispute Resolution

We encourage good-faith negotiation to resolve any disputes. If unresolved, the courts of Scotland will have jurisdiction, except where consumer protection laws provide otherwise.

10.3 Limitation on Claims

Any claim arising from use of MeloTune™ must be filed within one year of the cause of action arising.

11. Miscellaneous

11.1 Entire Agreement

These Terms constitute the entire agreement between you and MeloTune regarding use of the Service.

11.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

11.3 Assignment

You may not assign these Terms without our written consent. We may assign our rights at any time.
